Root for kids™ offers an online subscription leasing service ("RootLets") providing its members with access to a wide variety of toys, books, music and developmental materials (collectively, "materials"). We offer a basic subscription service, our Root Rewards program, and special promotional plans with varying costs and benefits depending on the program. Under all plans, members select materials at our website, or with Root Rewards potentially direct us to select the materials on their behalf, and receive the materials by United Parcel Service or some other common carrier and return them using prepaid mailers. When you direct us to select the materials on your behalf, you release root for kids™ from any claims or liability arising from our selections. Once you have indicated that a material is being returned, we mail you additional materials as appropriate.

We reserve the right in our sole and absolute discretion to make changes from time to time and without notice in how we operate the RootLets service or the programs therein. Below is a description concerning the operation of the RootLets service:

• The Leasing Of Materials
  
  The leasing of materials is based upon points associated with each material corresponding to the retail cost of the material. We offer a basic subscription that includes a certain minimum number of points. You may exceed this minimum number by paying in any given month for additional points. A Root Rewards Membership offers additional benefits, such as point discounts.
  
  Click on the "My Account" link, located at the top of the pages of www.rootforkids.com and see "Change Plans" for details on the various plans we offer. To view your current plan and other details, click on the "My Account" link. You may modify your plan in the Change Plan section of "My Account" if your current plan is not satisfying your needs.


• Delivery Speed
  
  We utilize a common carrier to send and receive materials that you have selected to lease. The delivery times you encounter will vary based on a number of factors including geographical location.


• Due Dates
  
  Provided you continue to be a paying member of our subscription service, you may keep materials as long as you like. We do not impose any required return dates (other than upon cancellation of the service). Given that we have no required return dates, we do not charge any late fees. Instead, your account will indicate that you have chosen to lease the appropriate materials for another month. To avoid being charged for another month, you must deposit the materials with the appropriate common carrier by the date indicated on your leasing invoice.
  
  You will be required to return the material within 7 days following any cancellation of the service or be subject to charge for the unreturned materials. Also, you may be charged for material that you lose or damage.
  
  You hereby authorize us to charge your Payment Method for any lost or damaged materials. We will alert you of any potential charges for lost or damaged materials prior to charging your Payment Method.


• Your Materials
  
  Materials that you select to lease will be noted in your account. You may add material or adjust selections at anytime. We will determine which material to send to you based on the material in your account.


• Delivery and Return of Leased Material
  
  Generally, we process requests within forty-eight hours. In certain instances, requested materials may not ship immediately. This can occur, for example, when your choice is not available or the number of shipments capable of being processed on that day has been exceeded. Other factors that may affect delivery times, include, but are not limited to the timing of your order circumstances impacting delivery by the common carrier, and any unplanned downtime of our computer systems. We receive mail from the United Parcel Service and process returns Monday through Friday, except Holidays. Generally all of the returns are processed on the same day received. We make no guaranty as to the shipping and delivery of material and may, in our sole and absolute discretion, change our business practice regarding delivery and shipping without notice.

• Billing
  
  The RootLets subscription service is offered on a month-to-month basis with no time commitment. By enrolling in the subscription service, you are expressly agreeing that we are authorized to charge you the minimum subscription fee for any month that you lease materials plus any additional fees for additional points, any applicable tax, and any other charges you may incur in connection with your use of the RootLets service to the Payment Method you provided during registration (or to a different Payment Method if you change your account information). Additional charges may include gift subscription purchases you make, material you fail to return or damage, or the service level changes you request. As a Root Rewards member, you are expressly agreeing that we are authorized to charge you a monthly membership fee in addition to the fees above. If you do not return leased materials by depositing them with the United Parcel Service or other indicated common carrier by the date on the "My Account" page and in your delivered materials, you will be charged the next months subscription fee (based upon the points associated with the leased materials). As used herein, "billing" shall indicate either a charge or debit, as applicable, against your Payment Method, including a checking account, where applicable. You acknowledge that the amount billed each month may vary from month to month for reasons that include, differing amounts due to promotional offers, differing amounts due to changes in your account, changes in the amount of applicable sales tax, and changes for lost or damaged materials or materials not returned upon cancellation or termination of your subscription, and you authorize us to charge your Payment Method for such varying amounts.
  
  The Root Rewards fee, will be billed at the beginning of your membership and on each monthly renewal thereafter unless and until you cancel your subscription. Click on the "My Account" page to see the commencement date for your next renewal period.We will automatically bill your Payment Method each month on the calendar day corresponding to the commencement of your Root Reward subscription. In the event your subscription began on a day not contained in a given month, we will bill your Payment Method on the last day of such month. For example, if you became a paying subscriber on January 31st, your Payment Method would next be billed on February 28th.
  
  We may also periodically authorize your card in anticipation of subscription or related charges. All fees and charges are nonrefundable and there are no refunds or credits for partially used periods. At any time, and for any reason, we may provide a refund, discount, bonus disc or other consideration to some or all of our subscribers ("credits"). The amount and form of such credits, and the decision to provide them, are at our sole and absolute discretion. The provision of credits in one instance does not entitle you to credits in the future for similar instances, nor does it obligate us to provide credits in the future, under any circumstance. We may change the fees and charges in effect, or add new fees and charges from time to time, but we will give you advance notice of these changes by email. If you want to use a different Payment Method or if there is a change in your credit card validity or expiration date, you may edit your Payment Method information by clicking on the "My Account" button. If your Payment Method reaches its expiration date, your continued use of the service constitutes your authorization for us to continue billing that Payment Method and you remain responsible for any uncollected amounts.


• Ongoing Root Rewards Membership
  
  Your Root Rewards membership will continue in effect unless and until you cancel your membership or we terminate it. You must cancel your membership before it renews each month in order to avoid billing of the next month's membership fees to your Payment Method. We will bill the monthly membership fee plus any applicable tax to the Payment Method you provide to us during registration (or to a different Payment Method if you change your account information).


• Cancellation
  
  You may cancel your Root Rewards membership or participation in the RootLets subscription service at anytime, and cancellation will be effective immediately. WE DO NOT PROVIDE REFUNDS OR CREDITS FOR ANY PARTIAL-MONTH MEMBERSHIP PERIODS OR UNUSED MATERIALS. To cancel follow the instructions on the "My Account" page. Upon cancellation, you will be given until the return date indicated on the "My Account" page and in your delivered materials to return any outstanding leased materials. Failure to return such materials will result in your Payment Method being billed for such items. We will send you a reminder email concerning unreturned materials prior to charging your Payment Method. We reserve the right to terminate your account for any or no reason.

We offer for sale on root for kids™ website various gift subscriptions redeemable for the RootLets subscription service. We also offer gift cards for sale. We will automatically bill your Payment Method for any purchased gift subscriptions and gift cards.

Gift subscriptions are for the time period designated and are not transferable after registration. The recipient of the gift subscription must register the gift subscription within one (1) year of the date of purchase. Gift cards must also be redeemed within one (1) year of the date of purchase. Gift subscriptions and gift cards that are not redeemed within one (1) year after date of purchase will, without further notice, expire. There are no refunds or other credit for unredeemed gift subscriptions or gift cards.

Recipients of a gift subscription will still need to register a payment method during the Gift Subscription period to assure a valid payment method is on file. No charges will be made against the payment method unless recipient does not return leased materials prior to the end of the leasing period, fails to return materials, or returns damaged materials. At the end of the gift subscription period, the recipient has the option of continuing as a normal subscriber.

Although the subscription is cancelable at anytime, there is no refund or credit for partially used periods.

We are not responsible for lost or stolen gift subscriptions or gift cards, except as required by law. Gift subscriptions and gift cards are valid in the 50 United States and its territories and possessions only. Gift subscriptions and gift cards are not redeemable or refundable for cash, cannot be resold and cannot be combined with any other special or free offers, including other gift subscriptions and gift cards.

The purchaser agrees that returns must be received within 30 days of initial invoice in the original unopened package. Payment will be returned, less shipping charges, through the same form it was received. Shipping of returns shall be by insured method. Damaged or defective products should be reported within 48 hours of receipt. Root for kids™ shop will forward return instructions for the damaged / defective product(s) and replacement goods will be shipped as soon as damaged product is received.
